Having non-consensual BB sex is rape. So yes there will be jail time.

I do not condone doing it but to be frank, it is not so black and white. He might be in trouble for other types of offense like sexual assault, but maybe not for rape. For one thing, the consent for sex was already established. Surely that throws out the rape charge.
