View Full Version : Question ANZAC day - is it illegal for shops to remain open

Hey guys, excuse my ignorance, but is it illegal for shops to remain open on ANZAC day. I wanted to try this new massage shop and when I called they said they are closed today and will only reopen tomorrow. When I read upon out of curiosity, apparently no businesses are allowed to function until midnight on ANZAC day. What has other people’s experience been? Cheers!

I'm copying from Fair Trading's website:
Anzac Day
As of 25 April 2025, all retail shops will be required to remain closed on Anzac Day to ensure the service of veterans is recognised and people are able to take part in services throughout the day.
Shops that were previously required to remain closed until 1pm on Anzac Day, will now need to remain closed for the entire day.
Shops that were exempt under the Shops and Industries Act 1962 will also be required to close on Anzac Day. Some exemptions from trading restrictions apply.
Seems from 2025 all should remain closed for whole day compared to previous years in which they could open after 1pm. However I just had a drive to neighbourhood anfmd most of the businesses were open (Big retailers like Coles. BIG W, Zara etc were closed)

Small businesses of up to 4 employees can trade as normal according to the rules...so I guess those small massage parlours can operate as usual

The legislated closures only apply to large retail chains. Small shops can continue to trade after 1:00pm. However, there seems to be a lot of confusion around this so I suspect many shops have decided it's all too hard and are remaining closed for the day.

Not entirely true. Small shops can open if they have no more than 4 staff working on any given day of the year. Also shops on the exempt list can open. Otherwise they must remain closed.

Pathetic backwards step for this small country town of a city. By all means, go get blind drunk and piss your money away on the pokies but god forbid you go get a root or go to the supermarkets to buy some food for dinner.
ANZAC Day has become a pathetic yobfest draped in misplaced national pride. Long lines for pubs, long lines for drinks, plastic cups and nowhere to sit. Yuck.

Hate how this country has red tape on so many businesses but fucking pubs and clubs can just rake in the cash from pokies and hire fob staff on less than min wage.
Anzac Day is just another day for cunts to get pissed and pretend they care about those who fought for this country.

Totally agree. Am i missing something here? Australians go and invade Turkey, and kinda fail at it. That's what its all about?

I have seen some massage shops listed on google maps as open. On their website NSW Fair Trading has a long list of shop types defined as Retail and Massage is not on that list. Shops selling prepared food as well as petrol stations are exempt. A retail shop seems to be a shop that sells things, as opposed to a service. I note that some Dentists and Medical Centres are open. Some busineses can apply for an exemption also. Because it is a public holiday and permanent staff get paid for taking the day off, it seems if casual staff of a small shop offering a health service might be exempt so long as the employees want to work. The law changed for 2025 such that Retail shops could not open from 1pm like they did in 2024.

Saw a regular today and she told me her Friday shop was closed for Anzac Day but a regular was begging the mamasan to see if she could come in for him. After some negotiating the lady agreed to come in when the client offered 4x the usual extras rate. She went in, did the 2hr job and went home to resume her day off with a nice payday. Punter was happy to pay penalty rates.
