Bros,

I have a question. If you go to a massage parlour (not licensed for FS) and give a tip upfront, without the ML even asking for a tip or specifying what that tip was for, and then proceed to have FS with her, does that mean prostitution has occurred?
I mean, since you gave the money willingly and without the ML naming a price for any particular service, it would be impossible to "bust" the ML because she could just say the money was received as an act of kindness from the customer and she had sex with the customer because she liked him. She technically did not "sell" anything.
If this is true, a shop can really make itself "immune" to brothel busting by playing its cards right. Use an innovative way of conveying their pricing, then leave the punters to speak with their wallets, literally.

Not necessarily, bro Wilisno. For one, not all shops will be savvy enough to use this method of operation. I reckon a shop will need to be pretty much on top of their game to pull this off. And even if there are a lot of shops that are successful working this way, there will always be licensed brothels with the best girls and punters will always flock to them. Look at Ginza or 5*... they will hold their own even if there were a lot of these shops competing against them because their girls are simply the best anywhere (in Sydney, that is).

In some countries, "soliciting prostitution" (e.g. ask and pay for sexual favors) is illegal, however if you give her money without asking anything and she has sex with you, it's technically not illegal.
It's pretty much a small loophole for MLs and unregistered brothels. However i doubt the courts will take your argument or accept that it's a loophole when you get arrested.

They either need to record their dealings or write it in a report. If they don't record their dealings, I don't think they would tell a lie in their report and risk breaking the law by perjury just to bust a shop. How would they know the shop was not recording them?

Brothel Busters don't need evidence to close down a shop, they're not the authority ! They just passed on the information to the relevant authority to take action, like sending in professional punters to gather evidence.

Reminds me of a café in the Cross where one could "purchase" Mary Jane. They used to put the MJ in a pot plant on the table for collection and the customer would leave a large tip on the table for their coffee. lol
